Applying for
Probate and
probate administration, often assumed to be a very difficult procedure, is the legal process to effectively deal with the distribution of a persons assets once they have passed away. So many times we hear people say things like "My mum died and she never made a will, so we had to apply for probate" or they say "My uncle died but he made a Will and we still had to apply for Probate". Many people do not understand why an estate would go to
probate or why a family needs to apply for
Probate.

Letter of Administration also known as
Letters of Administration and a
Grant of Probate. We will also help you to understand why a
Grant of Probate is necessary, when you need to apply for a
probate grant, how much
probate costs, what a
Caveat is and how to enter a
Caveat in order stop someone applying for a
Grant of Probate if there is a contentious
probate issue.
Probate outline - When does
Probate apply
If a person passes away owning assets in excess of £5,000 or if an institution is likely to pay your estate a sum in excess of £5,000 then a
Grant of Probate will most likely need to be applied for on the estate. Although some banks will accept a small estates indemnity form instead of a
Grant of Probate if the estate of the deceased person is under £15,000. If not
Probate or a
Letter of Administration will have to be applied for. In other words who ever is dealing with your affairs must apply for a
Grant of Probate. The greatest confusion with
probate is that the
probate application must be undertaken whether you make a will or not.
If you make a will your executors will apply for what is known as a
Grant of Probate if you did not make a will the person who is dealing with your affairs will become your estate administrators and will apply for a
Letter of Administration also known as
Letters of Administration . The
probate forms are the same whether you are applying for
Grant of Probate or applying for
Letters of Administration.

If you need help in preventing somebody applying for a
Grant of Probate (this is known as "Contentious Probate "), you can enter a
Caveat against the estate. This will stop the
Letters of Administration.

Caveat
A
Caveat is a simple form that can be lodged at any
Probate office which will stop somebody applying for
Probate. This is used when a contentious matter arises. Please take time to read the "Stopping

What is a
Grant of Probate
A
Grant of Probate is document issued by the High Court which will have a
Probate seal in the bottom corner and the persons will attached to it.
Letters of Administration are more or less the same piece of paper however there is obviously no will attached as
Letters of Administration are only issued if the deceased person did not make a will and thus died
intestate.
